Resort Rewards Program

IMPORTANT

To help Pheasant Run Resort & Spa Resort Rewards members fully understand the Resort Rewards program, the following Terms and Conditions have been prepared. The Terms and Conditions apply to all Resort Rewards members.

The Terms and Conditions govern participation in the Resort Rewards program. Each member is responsible for reading and understanding all of them.

Terms & Conditions

Program Changes
Pheasant Run Resort & Spa (“Pheasant Run”) may, at any time, without notice to the members of the Resort Rewards program (the “Program”), change the rules, processes, conditions, benefits, points or other awards of the Program, increase the Program point requirement to redeem any award, change or terminate award categories, change or terminate redemption locations, add hotel award blackout dates or limit the number of rooms available for award redemption.

Program Termination
The Program may continue until such time as Pheasant Run, at its sole discretion, elects to designate a Program termination date. Pheasant Run has the right to end the Program at any time by providing written notice to then-“Active Members” six months in advance of the termination date. An “Active Member” is a member who has received Program points within the preceding 12 months. All accounts will be closed on the termination date, and all Program points or Pheasant Run dollars (“PR Dollars”) that remain in any account on the termination date will be forfeited on that date. Written notice shall be deemed sufficient when sent by first class United States mail to the address that the member has provided to Pheasant Run.

Membership Eligibility
Membership in the Program is free. Membership is available to individuals over the age of 21. Each member may maintain only one Program account. The Program is not available to companies, associations, groups or other entities. The Program is not available to employees of Pheasant Run, Hilton Garden Inn St. Charles, Holiday Inn Express St. Charles, and OakBrook Hotels, Inc.

Non-Transferability
Program memberships are individual and can only be used by the member whose name is listed on the account. Memberships cannot be shared or combined with more than one person. Membership, Program points and PR Dollars are for the member’s benefit only and are not transferable to another person for any reason, including marriage, divorce, death or inheritance.

Prohibition on Sale
The sale or barter of any Program points, PR Dollars, awards, or benefits of any kind is prohibited. Program points or PR Dollars are not redeemable for cash or any other form of credit and have no value until presented for redemption in accordance with the rules governing the Program.

Lost Cards or Correspondence
Pheasant Run is not liable for (i) requests, correspondence, or deliveries that may be lost, misdirected or delayed in the mail or via electronic mail, (ii) Program enrollment forms or Program cards that may be incomplete, illegal, delayed, lost or stolen or (iii) pricing or typographical errors or errors in description. Points and PR Dollars cannot be reissued if a member’s card is lost, stolen, or otherwise destroyed.

Point Errors
Pheasant Run reserves the right to correct any Program points issued in error. In the event that a member believes that there is an error regarding number of points earned in an account, the member should contact Pheasant Run through its website or by phone, within 60 days of the transaction date, and should provide all relevant receipts.

Law Restrictions Apply
Earning of Program points and redemption of awards are subject to all applicable laws and regulations. This Program and participation therein are not valid where prohibited or restricted by law in the place of the member’s domicile.

Taxes
Program benefits and awards may be subject to income or other taxes. Such taxes and all disclosures related thereto are the sole responsibility of the recipient.

No Warranties or Representations
Pheasant Run makes no warranties or representations, either expressed or implied, and expressly disclaims any and all liability (including consequential damages) with respect to the type, quality or fitness of goods or services provided through the Program.

Violations of Program
Program violations, fraud or abuse involving the Program, failure to pay any valid bill or account when due to Pheasant Run, are subject to appropriate administrative and/or legal action by the appropriate governmental authorities and by Pheasant Run, including, without limitation, forfeiture of all Program points, cancellation of the Program account, and prohibition of future participation in the Program.

Program Interpretation
Interpretation of Program Terms and Conditions and other rules are in the sole discretion of Pheasant Run. Pheasant Run reserves the right to add, modify, delete or change these Terms and Conditions and any rules related to the Program in its sole discretion, with or without notice.

Address and Name Changes
Members shall promptly notify Pheasant Run of any change in address or name. Address or name changes of Resort Rewards members must be made in writing and include supporting legal documentation, signature, date and member account number, and sent to Pheasant Run, 4051 E. Main Street, St. Charles, Illinois 60174, Attention Resort Rewards Manager.

No Contract
Neither the Program nor any benefit offered by the Program constitutes or gives rise to any legal or contractual rights by Resort Rewards members.

Privacy Policy Applies
Information that is supplied by Resort Rewards members to Pheasant Run in connection with the Program is governed by Pheasant Run’s Privacy Policy.

Applicable Law
The Program, these Terms and Conditions, and all rules of the Program shall be governed by and construed in accordance with the laws of the state of Illinois.

Headings
The headings and titles of various sections of these Terms and Conditions are for convenience only and are not to be considered as defining or limiting in any way the scope or intent of the provisions hereof.
